1. Acceptance of Terms

By accessing this website, booking services, or engaging with Audacreek Cleaning LLC ("Company"), you ("Client") agree to be bound by these Terms & Conditions. If you do not agree, do not use this website or our services.

2. Services

The Company provides commercial office cleaning, apartment pre-move-in and post-move-out cleaning, and pre-event and post-event cleaning. All services are subject to availability and the Company’s sole discretion.

3. No Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

· All services and website content are provided "AS IS" and "AS AVAILABLE."
· The Company disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and workmanlike service.
· No oral or written information from the Company creates any warranty.

4. Limitation of Liability

IN NO EVENT SHALL THE COMPANY BE LIABLE FOR:

· Any indirect, incidental, consequential, special, or punitive damages
· Lost profits, lost revenue, or business interruption
· Property damage, personal injury, or emotional distress

TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY THE CLIENT FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

5. Indemnification

Client agrees to indemnify, defend, and hold harmless the Company, its owners, employees, and agents from any claims, damages, losses, or expenses arising from Client’s use of services, breach of these Terms, or violation of any law.

6. No Refunds

NO REFUNDS ONCE SERVICES COMMENCE. All deposits are non-refundable. Cancellation fees apply as set forth in the Refund & Cancellation Policy. Chargebacks are a material breach and result in full liability plus fees.

7. Binding Arbitration

Any dispute arising from these Terms or services provided shall be resolved exclusively through binding arbitration in Little Rock, Arkansas, under the rules of the American Arbitration Association.

· NO CLASS ACTIONS.
· NO JURY TRIAL.
· The arbitrator may award attorney fees to the prevailing party.

8. Governing Law

These Terms shall be governed by the laws of the State of Arkansas, without regard to conflict of laws principles. Exclusive venue for any permitted court action shall be Pulaski County, Arkansas.

9. Force Majeure

The Company shall not be liable for any failure or delay due to causes beyond its reasonable control, including acts of God, weather, labor disputes, equipment failure, or government actions.

10. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

11. Entire Agreement

These Terms, together with the Refund & Cancellation Policy and any Service Agreement, constitute the entire agreement between the Client and the Company, superseding all prior communications.
